Terms of Service

Please read these Terms of Service carefully before using MYSOVA. They form a legally binding agreement between you and MYSOVA LTD, and govern your access to and use of our app, waitlist site, and related services.
1. About These Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “your”) and MYSOVA LTD, a company registered in England and Wales (company number 17154283) with its registered office in London, United Kingdom (“MYSOVA”, “we”, “us”, “our”).
These Terms govern your access to and use of:
- The MYSOVA mobile application(“the App”) — available on iOS and Android.
- The app.mysova.co.uk waitlist site— including signup, referral, and status pages.
- The mysova.co.uk marketing site and any other MYSOVA-operated property that links to these Terms.
By creating an account, joining the waitlist, downloading, or using any part of the service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the service.
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms. We will notify you of material changes via the app or by email at least 30 days in advance.
2. Eligibility
You must be at least 18 years of age to use MYSOVA. By creating an account or joining the waitlist, you confirm that you are 18 or older. We verify your age at registration using your date of birth.
MYSOVA is launched in the United Kingdom, with our initial focus on London. We do not knowingly allow persons under 18 to use the service. If we discover that a user is under 18, their account will be immediately terminated and their data deleted.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Keep your password secure and not share it with anyone.
- Maintain only one account per person — duplicate accounts are not permitted.
- Notify us immediately at support@mysova.co.uk if you suspect any unauthorised use of your account.
- Provide accurate and truthful information at registration and keep it up to date.
We reserve the right to terminate accounts that violate these Terms or that we reasonably believe are fraudulent.
4. The Service
MYSOVA is a London nightlife social platform offering:
- Venue Discovery — browse, search, and explore nightlife venues across London.
- Check-In — verify your physical presence at a venue (within a 75-metre radius) to earn XP.
- XP & Ranking System— earn experience points through check-ins, social interactions, and challenges. Progress through ranked tiers from Owlet to Ultimate SOVA.
- Paths (Social Matching)— discover other users you have crossed paths with at venues. Mutual opt-in is required to match.
- Party Coordination— create and join party groups with friends for a shared nightlife experience.
- Oracle AI Recommendations— personalised venue and event recommendations based on your tastes, history, and current context. AI outputs are advisory only and do not restrict your access to features.
We may modify, suspend, or discontinue any feature or aspect of the service at any time with reasonable notice where practicable. Where a paid feature is permanently discontinued, affected subscribers will receive a pro-rata refund or credit.
5. Subscriptions & Billing
MYSOVA offers three consumer tiers:
- Free — core features available to all registered users at no cost.
- Explorer (£7.99/month)— enhanced features including extended Paths history, advanced filters, and priority Oracle queries.
- Icon (£14.99/month)— full access to all features, exclusive profile badges, boosted visibility, and premium Oracle capabilities.
App Store and Play Store billing. Subscriptions are billed monthly through your Apple App Store or Google Play account. Payment is charged to your account at confirmation of purchase. Subscriptions automatically renew at the same price unless you cancel at least 24 hours before the end of the current period. Auto-renewal is managed by Apple or Google in line with their respective subscription policies.
Restore Purchases. If you reinstall the app or change devices, you can restore an active subscription at any time from the in-app subscription screen. Your entitlement is tied to your Apple ID or Google account, not your MYSOVA login.
Refunds. Refund requests for in-app subscriptions are handled by Apple (App Store: reportaproblem.apple.com) or Google (Play Store account > Order history). MYSOVA cannot directly refund payments made through the App Store or Play Store.
Price changes.We may change subscription prices with at least 30 days' notice. Where Apple or Google requires affirmative consent for a price increase, your subscription will pause or end if you do not consent. Otherwise, continued use of the subscription after the price change takes effect constitutes acceptance.
App Store / Play Store EULA.Your use of the app is also subject to Apple's Standard EULA and Google Play's Terms of Service, as applicable. Where there is a conflict between these Terms and the platform EULA, the platform EULA prevails for matters of distribution, billing, and platform-specific entitlements.
6. Cancellation, Cooling-Off & Refunds
14-day cooling-off (Consumer Contracts Regulations 2013). As a UK consumer, you have a statutory right to cancel a new subscription within 14 days of purchase for a full refund. However, by starting to use the paid features inside the 14-day period, you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right to cancel once the service is fully performed (i.e. once each monthly billing cycle has ended). Your remaining statutory rights under the Consumer Rights Act 2015 are not affected.
Cancellation after the cooling-off period.You may cancel your subscription at any time through your device's App Store or Play Store settings. Upon cancellation, your access to paid features will continue until the end of the current billing period. No refunds are issued by MYSOVA for partial periods; refunds for App Store / Play Store purchases must be requested via Apple or Google.
Account deletion.Deleting your MYSOVA account does not automatically cancel an active App Store or Play Store subscription. You must cancel the subscription separately from your device's subscription settings.
7. User Conduct
You agree not to use MYSOVA to:
- Harass, threaten, bully, or harm other users or venue staff.
- Post or transmit hate speech, discriminatory content, or material that incites violence.
- Impersonate any person, venue, organisation, or MYSOVA staff member.
- Solicit other users commercially without our prior written consent.
- Artificially inflate your XP, rank, or engagement through bots, scripts, or exploits.
- Submit fake check-ins or misrepresent your location.
- Scrape, crawl, or extract data from the service for commercial purposes.
- Circumvent any security, access control, or technical measure within the service.
Online Safety Act 2023 prohibitions. You must not upload, post, transmit, link to, or otherwise make available through the service any content that constitutes:
- Child sexual abuse material (CSAM) or any content that sexualises a minor.
- Terrorism content, content that encourages or assists terrorism, or material from a proscribed organisation.
- Intimate-image abuse (so-called “revenge porn”) or content shared without the subject's consent.
- Content that incites or threatens violence, or is grossly offensive, obscene, or menacing.
- Content facilitating fraud, controlled-drug supply, illegal firearms, human trafficking, or other priority offences listed in the Online Safety Act 2023.
- Content harassing, threatening, or abusing any individual, including coordinated harassment.
Violations may result in content removal, temporary suspension, or permanent account termination at our sole discretion. Reports of illegal content can be made via the in-app reporting tools or by emailing legal@mysova.co.uk. We cooperate with law enforcement and Ofcom (the regulator under the Online Safety Act) where required.
8. User Content & Reporting
You retain ownership of any content you submit to MYSOVA, including profile photos, biography text, messages, and other materials (“User Content”).
By submitting User Content, you grant MYSOVA a non-exclusive, royalty-free, worldwide, sublicensable licence to use, display, reproduce, and distribute your User Content solely within the service and for the purpose of operating, promoting, and improving it. This licence ends when you delete your User Content, except for residual copies in backups (purged on a rolling basis).
You represent and warrant that you have the rights to submit User Content and that it does not infringe any third-party intellectual property, privacy, or other rights.
You must not post User Content that is illegal, defamatory, obscene, or violates these Terms. We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms — without prior notice.
Reporting and blocking. Every user can report inappropriate content, harassment, or safety concerns via the in-app reporting tools (photos, messages, profiles). Every user can also block another user, hiding their content and preventing further contact. Content that receives multiple independent reports is automatically hidden pending review.
9. Location Data
Check-in verification requires access to your device's location. We use your precise location to confirm you are within 75 metres of a venue before awarding XP for a check-in.
You control location sharing through your device's privacy settings and through MYSOVA's Phantom Mode feature. When Phantom Mode is enabled, your live location is not visible to other users, although your check-in is still recorded for your own history and XP. You can also configure location visibility (Everyone, Friends, Nobody) from within the app's privacy settings.
We collect and use location data in accordance with our Privacy Policy. We do not sell your precise location data to third parties.
10. Intellectual Property
All content, design, code, branding, and systems within MYSOVA — including but not limited to the MYSOVA name and logo, the XP and ranking system, the Oracle AI interface, the Paths matching algorithm, and the Live Floor system — are the exclusive intellectual property of MYSOVA LTD or its licensors, protected by UK and international copyright, trade mark, and other intellectual property laws.
You may not copy, reproduce, reverse-engineer, decompile, modify, distribute, or create derivative works based on any part of the service or its content without our express written permission. Any unauthorised use may result in legal action.
Aggregated and anonymised data. MYSOVA may use aggregated and anonymised data derived from app usage to improve the service, benchmark industry trends, and publish general insights. Such data will not identify you.
Feedback. If you provide feedback, suggestions, or feature requests, you grant MYSOVA a perpetual, irrevocable, royalty-free licence to use that feedback without obligation or attribution.
11. Limitation of Liability
The service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, except for those that cannot be excluded under applicable UK law.
To the maximum extent permitted by applicable UK law:
- MYSOVA's total aggregate liability to you for any and all claims arising out of or in connection with the service or these Terms shall not exceed the greater of (a) the total subscription fees you paid to MYSOVA in the 12 months immediately preceding the event giving rise to the claim, or (b) £100.
- MYSOVA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings, whether arising in contract, tort (including negligence), strict liability, or otherwise.
- MYSOVA shall not be liable for venue conditions, safety, or quality, or for any experience you have at a venue discovered through the app, nor for actions, behaviour, or interactions with other users.
Preserved rights.Nothing in these Terms excludes or limits MYSOVA's liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any matter for which it would be unlawful for us to exclude or restrict liability under applicable UK law, including your statutory rights under the Consumer Rights Act 2015.
12. Termination
You may delete your account at any time from within the app's settings. Upon deletion, your profile and associated data will be removed in accordance with our Privacy Policy and applicable data protection laws.
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in conduct harmful to other users or to MYSOVA, or where we are required to do so by law.
Upon termination, your right to use the service ceases immediately. Any provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnities, and governing law — will continue to apply.
13. Disputes, Governing Law & Jurisdiction
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. Nothing in this clause affects your statutory rights as a consumer to bring proceedings in the courts of your country of residence within the United Kingdom.

14. Changes to These Terms
MYSOVA reserves the right to update or modify these Terms from time to time. When we make material changes, we will:
- Update the version number and effective date at the top of this page.
- Provide notice via email to registered users and/or a prominent notice within the service at least 30 days before material changes take effect.
Your continued use of the service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the service and delete your account.
